Terms & Conditions of Sale

These Terms & Conditions ("Terms") govern your use of https://maptun.com.au ("our site") and your purchase of products from Paul Jacob Kurpiewski, trading as Maptun Australia (ABN 84 181 449 571) ("we", "us", "our"). By placing an order, you agree to these Terms. Please read them together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law (ACL) that cannot be excluded.

1. About our products

We supply tuning licenses, software, Maptuner hardware, cables, adapters, dealer-service applications and related performance products.

  • Many products are digital activations (licenses/software) that may be tied to a VIN, ECU, Maptuner device or account.
  • A compatible Maptuner device and the correct vehicle cable may be required before a license can be used.
  • It is your responsibility to confirm that a product is compatible with your vehicle and setup before purchase. If you are unsure, contact us for fitment help before ordering.

2. Pricing and GST

  • All prices are shown in Australian dollars (AUD) and are inclusive of GST unless stated otherwise.
  • We may change prices at any time, but changes will not affect orders we have already accepted.
  • We make every effort to ensure pricing is accurate. If a pricing error is identified, we may cancel the affected order and refund any amount paid (see clause 4).

3. Orders and acceptance

  • Your order is an offer to purchase. A contract is formed only when we confirm and accept your order.
  • We reserve the right to refuse or cancel any order, including where a product is unavailable, where we suspect fraud, where a pricing or description error has occurred, or where compatibility cannot be confirmed.
  • For some products, we may require additional vehicle or device information before processing your order.

4. Payment

  • Payment must be made in full at the time of order using the payment methods offered at checkout.
  • Payments are processed by our third-party payment provider. By submitting payment details you confirm you are authorised to use the payment method.
  • We do not store full card details on our systems.

5. Delivery and activation

Digital products are issued by email and/or activation; physical products are shipped. Delivery, dispatch times and activation requirements are set out in our Shipping Policy.

6. Licenses and acceptable use

  • Licenses and software are provided for use with the specific vehicle, ECU, device or account they are issued for, and may not be transferred, copied, resold or reverse-engineered except as permitted by law.
  • You are responsible for using our products lawfully and safely.
  • Tuning and performance modifications may affect your vehicle's warranty, emissions compliance, roadworthiness and insurance, and may not be legal for road use in all jurisdictions. You are solely responsible for ensuring your use complies with all applicable laws, regulations and registration/road-use requirements in your location. Products may be intended for closed-course, competition or off-road use only where indicated.

7. Returns and refunds

Your rights to returns and refunds are set out in our Returns & Refunds Policy, which forms part of these Terms. In summary, we do not offer change-of-mind refunds, and activated digital licenses are non-refundable, except where required by the Australian Consumer Law.

8. Consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those guarantees.

9. Limitation of liability

To the maximum extent permitted by law, and subject to the consumer guarantees that cannot be excluded:

  • our total liability to you for any claim arising out of or in connection with a product or these Terms is limited, at our option, to the resupply of the relevant product or the cost of resupplying it; and
  • we are not liable for any indirect, incidental or consequential loss, or for any damage to vehicles, engines, ECUs or property arising from improper installation, use, or modification, or from use that is not compliant with applicable laws or product instructions.

10. Intellectual property

All content on our site, including text, graphics, logos, images, software and the "Maptun" and "Maptuner" brands, is owned by us or our licensors and is protected by intellectual property laws. You may not use it without our prior written permission.

11. Privacy

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

12. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the version published on our site at the time you place your order.

13. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
